TERMS AND CONDITIONS

Please read these Terms and Conditions (“Terms”) carefully before using the website located at www.jdslawoffice.com (the “Site”) operated by JDS Law Office (“Firm,” “we,” “us,” or “our”). These Terms govern your access to and use of the Site and constitute a legally binding agreement between you (“User” or “you”) and JDS Law Office.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Site.

Your access to and use of the Site constitutes your acceptance of these Terms and our Privacy Policy and Cookie Policy, each of which is incorporated herein by reference. These Terms apply to all visitors, users, and others who access or use the Site. We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. 2. No Attorney-Client Relationship

Accessing or using this Site does not create an attorney-client relationship between you and JDS Law Office or any of its attorneys. An attorney-client relationship is formed only upon execution of a written engagement agreement signed by both the client and an authorized representative of JDS Law Office.

Do not transmit confidential or sensitive information through this Site unless and until a formal attorney-client relationship has been established. Unsolicited communications submitted through this Site will not be treated as confidential and do not obligate the Firm to represent you.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JDS LAW OFFICE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

JDS Law Office does not warrant that: (i) the Site will be available, uninterrupted, or error-free; (ii) defects will be corrected; (iii) the Site or the server that makes it available are free of viruses or other harmful components; or (iv) the information on the Site is accurate, complete, reliable, current, or suitable for any particular purpose.


6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JDS LAW OFFICE AND ITS ATTORNEYS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. 7. Indemnification

You agree to indemnify, defend, and hold harmless JDS Law Office and its attorneys, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of or access to the Site; (ii) your violation of these Terms; (iii) your violation of any third-party right; or (iv) any content you submit through the Site.


8. Payment Terms and Processing Fees

Where payment for legal services is made through the Site or otherwise by credit card or debit card, a 2.99% card processing fee will be applied to the total amount of each transaction. This fee is assessed by our third-party payment processor and is non-refundable. By submitting a credit card or debit card payment, you authorize the applicable charge including the processing fee.

Clients who wish to avoid the card processing fee may remit payment via check, ACH/wire transfer, or such other payment methods as the Firm may make available. All fees and payment obligations are governed by the terms of any applicable engagement agreement between you and JDS Law Office.


9. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by JDS Law Office. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We do not endorse any third-party websites or services. You acknowledge and agree that JDS Law Office shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any such third-party content, goods, or services.


10. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in those policies. Please review our Privacy Policy and Cookie Policy carefully.


11. Jurisdictional Limitations and Compliance

JDS Law Office is licensed to practice law in specific jurisdictions. The information on this Site is not intended to solicit clients or represent that the Firm is authorized to practice law in any jurisdiction where it is not licensed. 12. Governing Law and Dispute Resolution

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.


B. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to binding arbitration administered by a mutually agreed-upon arbitration service, in accordance with its applicable rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.


C. Class Action Waiver

YOU AND JDS LAW OFFICE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and JDS Law Office agree otherwise, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.


D. Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.


13. Termination

JDS Law Office reserves the right, in its sole discretion, to suspend or terminate your access to the Site at any time and for any reason, with or without notice, including if we believe you have violated these Terms. Upon termination, all licenses granted to you under these Terms will immediately cease. Sections that by their nature should survive termination — including but not limited to Sections 4 (Intellectual Property), 5 (Disclaimer of Warranties), 6 (Limitation of Liability), 7 (Indemnification), and 12 (Governing Law and Dispute Resolution) — shall survive.
